Rules for Ordering, Payment and Refunds for Services on the Lifelong Learning Centre Platform

These Rules govern registration for training courses, micro-credential programmes and STEAM activities offered on the Kauno kolegija Lifelong Learning Centre Platform, payment for such services, and refunds of amounts paid when a Service is ordered through the Platform. The terms and conditions of a specific Programme supplement these Rules. A separate agreement is additionally concluded for STEAM activities and micro-credential programmes; no separate written agreement is concluded for other training courses. In all cases, mandatory provisions of applicable law shall apply.

1. Definitions and Scope

Kauno kolegija – the service provider.

Platform – the electronic registration and payment environment of the Kauno kolegija Lifelong Learning Centre.

Service – a training course, micro-credential programme or STEAM activity offered on the Platform.

Programme – a description of a specific Service specifying its content, duration, format, time, location, price and additional terms and conditions.

Participant – a person registered to participate in a Service.

Customer – a person or organisation ordering and/or paying for a Service for a Participant.

Payer – the Participant or Customer whose funds are used to make the payment.

Separate Agreement – an additional individual agreement concluded in respect of a STEAM activity or micro-credential programme with the Participant, their legal representative and/or the Customer in accordance with the terms and conditions of the specific Service.

2. Information about the Service and Registration

2.1. Before registration, the Platform provides the essential details of the Service and, where the Service is subject to a fee, the total price payable and available payment methods. The fee covers the organisation and provision of the Service as described, as well as any related costs included in the price, unless otherwise specified in the Programme or, where applicable, in the Separate Agreement.

2.2. When registering, the Participant, their legal representative or the Customer shall provide accurate information required for registration and provision of the Service, review the Programme and these Rules, and submit an order through the Platform. Where no Separate Agreement is concluded, the terms and conditions for ordering and providing the Service shall be governed by these Rules and the Programme. Where a Separate Agreement is concluded, the procedure for its conclusion and confirmation of registration shall be specified in the terms and conditions of the relevant Service. Information about the status of registration and payment shall be provided through the Platform and/or via the contact details provided during registration.

2.3. The Participant's inclusion in the list of participants in the Service shall be confirmed once all applicable registration requirements have been fulfilled, including the conclusion of a Separate Agreement, where required, and, where applicable, receipt of payment confirmation. Submission of a registration alone does not guarantee a place in the group.

2.4. The Service shall be provided once the minimum number of participants determined by the Service provider has been reached, where such a minimum applies. Participants shall be informed, using the contact details provided during registration, of confirmation that the Service will take place, its cancellation, or any material change to its time, location or mode of delivery after registration closes, but no later than 2 working days before the scheduled commencement of the Service. This time limit may not apply to a Service provided under a Separate Agreement or where it is objectively impossible to give earlier notice of unforeseen circumstances.

3. Payments and Accounting Documents

3.1. To pay for a fee-based Service, the Payer shall click “Pay” on the Platform and select one of the available payment methods. Where electronic banking or Paysera is selected, payment shall be made within the environment of the relevant bank or payment service provider in accordance with the instructions provided therein.

3.2. Kauno kolegija does not receive or store electronic banking login details, PIN codes, passwords or other payment authentication data.

3.3. Payment shall be deemed completed when Kauno kolegija receives confirmation from the bank or payment service provider that the transaction has been successfully completed and is able to link the payment to the relevant registration. Upon receipt of this information, the registration shall be marked as paid.

3.4. If the transaction is not completed, is rejected, or payment confirmation is not received by the specified deadline, the registration may be regarded as unpaid and a place in the group shall not be guaranteed. Before the registration is cancelled, the Participant may be notified by email or telephone. If there is uncertainty regarding the allocation of a payment to a registration, the Payer may submit proof of payment using the contact details specified in Clause 8.1.

3.5. An invoice or other accounting document shall be issued upon receipt of information confirming successful payment and sent to the email address provided during registration, unless otherwise agreed with the Customer.

4. Provision of the Service and Obligations of the Parties

4.1. Kauno kolegija shall provide the Service in accordance with the published Programme and inform the Participant of any material changes thereto. The Participant shall comply with the participation requirements specified in the Programme and provide in a timely manner any information necessary for the provision of the Service.

4.2. Where the Service is provided via Zoom, Microsoft Teams or another remote learning tool, the Participant shall ensure that they are able to join the training using the link provided. If the Participant fails to join or is unable to participate properly in the training due to internet connection or equipment issues beyond the control of Kauno kolegija, any refund shall be assessed in accordance with Section 5, the terms and conditions of the Programme, and applicable law.

4.3. If, due to justified or unforeseen circumstances, the Service cannot be provided at the published time, location or in the published format, Kauno kolegija may propose an alternative and shall inform the Participant thereof using the contact details provided during registration.

5. Withdrawal from the Service, Cancellation and Refunds

5.1. If Kauno kolegija decides not to provide the Service because the minimum group size has not been reached or due to other circumstances, the full amount paid for the Service that was not provided shall be refunded using the same payment method or transferred to a bank account specified by the Payer within 14 calendar days of notification of the cancellation. The fee may be transferred to another Service only with the agreement of the Participant or Customer.

5.2. If a proposed change to the time, location or mode of delivery of the Service is material and, as a result, the Participant is reasonably unable to participate, the Participant may withdraw from the part of the Service that has not yet been provided. The amount paid for that part shall be refunded unless the parties lawfully agree otherwise.

5.3. Where, under applicable law, a Consumer has the right to withdraw from a distance contract for the provision of a Service, the Consumer may exercise this right within 14 calendar days of concluding the contract without giving any reason. The Consumer shall clearly communicate their decision to withdraw using the contact details specified in Clause 8.1. Where, at the Consumer's express request, provision of the Service begins before the expiry of this period, payment for the part of the Service properly provided up to the time of withdrawal and any exceptions to the right of withdrawal shall be determined in accordance with applicable law. This provision does not restrict any other statutory rights of the Consumer.

5.4. Where a Consumer lawfully withdraws from the Service, any refundable amounts shall be reimbursed no later than 14 calendar days from receipt of the notice of withdrawal, using the same means of payment used by the Consumer, unless expressly agreed otherwise and provided that the Consumer does not incur any additional costs as a result.

5.5. If the Participant fails to attend, joins late, or fails to complete the Programme for reasons beyond the control of Kauno kolegija and the Service provider, any refund shall be assessed in accordance with the terms and conditions of the specific Programme, the Separate Agreement, where one has been concluded, and applicable law. Any attendance threshold, where applicable, shall be specified in the terms and conditions of the specific Programme. This provision does not restrict the Consumer's statutory right to withdraw from the Service or their right to a refund for a Service that has not been provided or has been improperly provided.

5.6. A refund request need only specify the relevant order or registration, the identity of the Payer, the grounds for the request and, where a refund using the original payment method is not possible, the bank account to which the funds should be transferred. Where payment was made by the Customer, the funds shall be refunded to the Payer, taking into account the Separate Agreement and applicable law.

6. Personal Data

6.1. Data relating to registration, provision of the Service, payment records and notifications shall be processed in accordance with the Lifelong Learning Centre Platform Privacy Policy, the general Kauno kolegija Privacy Policy, and applicable data protection legislation. Mandatory communications relating to an order do not constitute consent to direct marketing.

7. Liability and Application of the Rules

7.1. The parties shall be liable, in accordance with applicable law, for failure to fulfil obligations assumed under the order and, where applicable, the Separate Agreement. In the event of any discrepancy between the provisions of the relevant documents, the Separate Agreement applicable to the specific Service shall prevail over the terms and conditions of the Programme and these Rules, and the terms and conditions of the Programme shall prevail over these Rules. No provision shall restrict any rights granted to Consumers by law.

7.2. The version of these Rules and the Programme made available at the time the order is submitted shall apply to that order, except for terms lawfully established in a Separate Agreement. Amendments shall be published on the Platform and shall not apply retroactively to orders already submitted, except where provided for by law or agreed between the parties.

8. Enquiries and Disputes

8.1. Enquiries concerning registration, payment, Service quality, withdrawal and refunds should be addressed to Kauno kolegija at: mvgc@kaunokolegija.lt, +370 608 04478. The enquiry should describe the relevant circumstances and include any available order or payment details.

8.2. Kauno kolegija shall examine a Consumer's written complaint and provide a reasoned written response within 14 calendar days of receipt. If the dispute is not resolved, the Consumer may refer the matter to the State Consumer Rights Protection Authority or to a court in accordance with the procedure established by law. Other disputes shall be resolved through negotiations or, if no agreement is reached, in accordance with the procedure established by law.
